These Terms of Service ("Terms") govern Your access to and use of the website at anotherlevelgames.co.uk, our games and applications, our Discord and other official community channels, and any related services (together, the "Services"), operated by Another Level Games ("Company", "We", "Us", "Our").
By accessing or using the Services, You agree to be bound by these Terms. If You do not agree, please do not use the Services.
These Terms sit alongside our End User License Agreement, which governs Your licence to install and use our software, and our Privacy Policy, which explains how We handle Your personal data. Where these Terms and the EULA conflict on a matter relating specifically to the software licence, the EULA controls.
1. Eligibility
You must be at least 13 years old to use the Services. If You are under the age of majority in Your country, You may only use the Services with the involvement and consent of a parent or legal guardian, who agrees to these Terms on Your behalf and is responsible for Your activity.
By using the Services, You confirm that You are able to form a binding contract with Us and that You are not barred from doing so under any applicable law.
2. Use of the Website
We grant You permission to access and view the Website for Your personal, non-commercial use. You agree not to:
- Use the Website in any way that breaches applicable law or these Terms;
- Attempt to gain unauthorised access to the Website, its servers, or any connected system;
- Interfere with or disrupt the Website, including by introducing malware, or by scraping, crawling, or overloading it with automated requests;
- Copy, reproduce, or redistribute substantial portions of the Website's content without Our written permission;
- Use Our name, logos, or branding in a way that suggests endorsement or affiliation without Our written permission.
We may change, suspend, or discontinue any part of the Website at any time without notice.
3. Accounts
Some features require You to create an account or connect a third-party account (such as Discord or a store platform account). You agree to provide accurate information, to keep Your credentials confidential, and to notify Us promptly of any unauthorised use of Your account.
You are responsible for all activity that occurs under Your account. We may refuse, suspend, or terminate an account that We reasonably believe has been used in breach of these Terms.
4. Games, Conduct, and Community
Our games and community channels include social and multiplayer features. When using them, You agree not to:
- Harass, threaten, bully, defame, or discriminate against other users;
- Post or transmit hate speech, sexually explicit material, or content that is unlawful or harmful to minors;
- Cheat, use bots, exploits, hacks, or unauthorised third-party software, or otherwise gain an unfair advantage;
- Impersonate another person, the Company, or Our staff and moderators;
- Share, sell, or trade accounts, or engage in real-money trading of in-game items;
- Advertise, spam, or solicit other users without Our permission;
- Share other people's personal information without their consent.
We may remove content, mute, restrict, suspend, or permanently ban accounts that breach these rules or our community guidelines. Where practical and appropriate, We will explain the reason for an enforcement action, and You may appeal by contacting Us at the address in section 13. Serious breaches such as cheating, fraud, or abuse of other users may result in an immediate and permanent ban without prior warning.
5. User-Generated Content
You may be able to submit content through the Services or Our community channels, including messages, names, images, video, feedback, and bug reports ("User Content"). You retain ownership of Your User Content.
By submitting User Content, You grant the Company a worldwide, non-exclusive, royalty-free, sublicensable licence to use, host, store, reproduce, adapt, publish, and display that content for the purposes of operating, promoting, and improving the Services. You confirm that You have the rights necessary to grant this licence and that Your User Content does not infringe anyone else's rights.
We do not pre-screen User Content and are not responsible for it, but We may remove any User Content at Our discretion.
If You send Us suggestions, ideas, or feedback about the Services, We may use them without restriction, obligation, or compensation to You.
6. Purchases and Virtual Items
Our games may offer paid content, including downloadable content, virtual currency, and virtual items such as cosmetics ("Virtual Items"). The following applies to all purchases:
- Purchases are generally processed by third-party store platforms (such as the Meta Horizon Store, Steam, or a mobile app store). Those platforms' own terms, payment methods, and refund policies apply to the transaction, and We do not receive or store Your payment card details.
- Virtual Items are licensed to You, not sold. They have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred outside the Services.
- All prices are shown inclusive of applicable taxes where required. Prices may change at any time; changes do not apply retroactively to completed purchases.
- We may modify, rebalance, or remove Virtual Items, including during Alpha or Beta testing, and progress or items may be reset while a title is in development.
- If Your account is terminated for a breach of these Terms, You lose access to any Virtual Items associated with it without refund.
Refunds. Because purchases are made through third-party stores, refund requests should be directed to the store You purchased from in the first instance. If You are a consumer in the UK or EU, nothing in these Terms affects Your statutory rights, including any right to cancel a purchase of digital content within the applicable cooling-off period. Note that where You request immediate access to digital content and acknowledge the loss of that right, the cancellation right may no longer apply. If a store cannot help You, contact Us and We will do what We reasonably can.
7. Alpha, Beta, and Early Access
Titles marked as Alpha, Beta, or otherwise in active development are provided on an experimental basis. They may be incomplete or unstable, features may change or be removed without notice, servers may be taken offline, and accounts, progress, or items may be reset. Content purchased or earned in these periods is provided without any guarantee of continued availability.
8. Intellectual Property
The Services, including all software, art, code, audio, text, design, trade marks, and branding, are owned by the Company and its licensors and are protected by copyright, trade mark, and other intellectual property laws. Except for the limited permissions granted in these Terms and the EULA, no rights are transferred to You.
You may create and share videos, streams, screenshots, and other fan content featuring Our games for non-commercial purposes and for monetisation through standard platform programmes (such as YouTube or Twitch partner revenue), provided You do not imply official endorsement, do not charge for access to the content itself, and do not use Our assets to create competing products. We may withdraw this permission at any time.
If You believe content on the Services infringes Your copyright, contact Us at the address in section 13 with details of the work, the location of the material, and a statement of Your good-faith belief that the use is unauthorised.
9. Third-Party Services and Links
The Services link to and rely on third-party platforms, including Discord, YouTube, TikTok, and store platforms. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of them is governed by their own agreements.
10. Disclaimer of Warranties
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any defect will be corrected.
Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including the statutory rights of consumers.
11. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses, arising from Your access to or use of, or inability to use, the Services.
To the maximum extent permitted by law, Our total aggregate liability arising out of or relating to the Services shall not exceed the greater of the amount You paid Us in the twelve months before the event giving rise to the claim, or £100.
Nothing in these Terms limits Our liability for death or personal injury caused by Our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
12. Suspension and Termination
You may stop using the Services at any time and may request deletion of Your account by contacting Us.
We may suspend or terminate Your access to all or part of the Services, with or without notice, if You breach these Terms, if We are required to do so by law, or if We discontinue the Services. Sections relating to intellectual property, User Content licences, disclaimers, limitation of liability, and governing law survive termination.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above, and where changes are material We will make reasonable efforts to notify You through the Services or Our community channels. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the United Kingdom, without regard to conflict of law provisions, and the courts of the United Kingdom shall have jurisdiction over any dispute. If You are a consumer resident elsewhere, You retain the benefit of any mandatory protections of the law of Your country of residence.
Before starting formal proceedings, We ask that You contact Us so We can try to resolve the matter informally.
15. General
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. You may not assign or transfer these Terms without Our consent; We may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the EULA and Privacy Policy, are the entire agreement between You and Us regarding the Services.
